Discussed what mediation is and how it works
Law of Ukraine "On Mediation" from 11/16/2021.
What is mediation?
- it is a structured negotiation process between parties in a conflict
- with the participation of a neutral and independent intermediary - a mediator
- who helps the parties to independently find a mutually beneficial solution that meets their interests
Figured out who a mediator is and what role they play in the process
A mediator is a specially trained intermediary who helps the parties to a conflict (dispute) resolve it through a structured negotiation process.
Found out what a mediator does
When to apply family mediation:
In cases where maintaining good relationships is no less important than resolving the dispute on the merits:
- in divorce
- in conflicts between parents and children
- on matters of adoption and guardianship
- regarding inheritance
- in other family disputes
Noted the main principles of mediation
Advantages of mediation:
- allows taking into account the needs of each party to the conflict and the child
- it is faster and less stressful than a court procedure for the parties to the conflict and children
- has a high percentage of implementation of decisions, as they are developed by the parties to the conflict themselves
- promotes the restoration of mutual respect between the parties to the conflict
- reduces stress for all participants
- saves resources, time, and emotional energy
- enforceability of agreements (>80%)
- restores the ability to negotiate in the future
